Copyright & takedown

How to report infringement and request the removal of content from our website, platforms, or hosted deliverables — in compliance with the Copyright Act, 1957, the IT Act, 2000, and the IT Rules, 2021.

Social Corn (A Unit of The Studio Nuqaat Store) respects the intellectual property rights of others and expects its clients and users to do the same.

In compliance with the Copyright Act, 1957, the Information Technology Act, 2000, and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have established the following procedure for reporting alleged copyright infringement and requesting the removal of infringing content from our website, platforms, or hosted deliverables.

1. Notice of Copyright Infringement (Takedown Request)

If you are a copyright owner, or are authorised to act on behalf of one, and you believe in good faith that any material provided through our Services infringes upon your copyrights, you may submit a formal written notice ("Takedown Notice") to our designated Grievance Officer.

To be valid under Indian law, your Takedown Notice must include the following information:

  • Identification of the Copyrighted Work: A clear description of the copyrighted work that you claim has been infringed. If multiple works are covered by a single notice, please provide a representative list.
  • Identification of the Infringing Material: A description of the material that you claim is infringing, along with sufficient details (such as the specific URL or project deliverable name) to permit us to locate the material on our platforms.
  • Contact Information: Your full legal name, mailing address, telephone number, and email address.
  • Statement of Good Faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • Statement of Accuracy: A statement that the information in the notice is accurate, and under penalty of perjury or equivalent legal liability in India, that you are the copyright owner or are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Signature: A physical or electronic signature of the copyright owner or the person authorised to act on their behalf.

2. Processing the Takedown Notice

Upon receipt of a valid and complete Takedown Notice, Social Corn will take the following actions:

  1. Acknowledge the receipt of the complaint within twenty-four (24) hours.
  2. Review the claim and, if valid, disable access to or remove the allegedly infringing material within the legally mandated timeframe (typically thirty-six (36) hours under the IT Rules, 2021).
  3. Notify the user or client who provided the allegedly infringing material that it has been removed or disabled.
Submitting a false or misleading Takedown Notice may result in civil or criminal liabilities under Indian law.

3. Counter-Notice Procedure

If you believe that the material you posted or supplied was removed (or to which access was disabled) by mistake or misidentification, you may send a Counter-Notice to our Grievance Officer.

Your Counter-Notice must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed and the location (URL) at which the material appeared before it was removed.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the courts in New Delhi, Delhi, India, and that you will accept service of process from the person who provided the original Takedown Notice.

If a valid Counter-Notice is received, Social Corn may restore the removed material within a reasonable timeframe, unless the original complaining party notifies us that they have filed a legal action seeking a court order against the content provider.

4. Repeat Infringer Policy

In accordance with applicable Indian laws, Social Corn maintains a strict "Repeat Infringer" policy. We reserve the right to terminate, in appropriate circumstances and at our sole discretion, the accounts, subscriptions, or service agreements of clients or users who are deemed to be repeat copyright infringers.
